Popcorn smell fuels popcorn war

CHICAGO, May 17 (UPI) -- The mouth-watering aroma of freshly popped popcorn is fueling a legal battle in Chicago between a small shop and residents of a downtown high-rise.

Garrett's, a local popcorn shop, sublet space once occupied by a Ben & Jerry's Ice Cream shop for a new store set to open this week in the Oriental Theatre building, but tenants in offices above the restored theater have gone to court to fight for their right to breathe fresh air.

A lawyer hired by the building's owners tells the Chicago Sun-Times having a popcorn shop near a stairwell on the ground floor would be "akin to sitting next to the company microwave and popping popcorn all day, everyday, nonstop."

"While Garrett's popcorn may be a Chicago tradition living with that popcorn odor in an office environment all day, every day, is much different," said attorney Shannon Capone Kirk.
