CHICAGO, Dec. 9 (UPI) -- A trademark infringement battle between Chicago's Billy Goat Tavern and Cheeburger, Cheeburger, a Florida-based chain, has moved into a federal court.

Billy Goat owner Sam Sianis has used "cheezborger, cheezborger" to advertise his local restaurants since the mid-1980s. The phrase was made famous by comedian John Belushi in parodies of Greek restaurants on "Saturday Night Live" in the 1970s.

The skit had a counter manager shouting, "Cheesborger, cheezborger, cheezborger ... no Pepsi, Coke. No fries, cheeps."

Cheeburger Cheeburger Restaurants Inc. has been in business since the mid-1980s.

Sianis didn't care about the Cheeburger Cheeburger chain of 32 family-style restaurants until they announced plans to open in suburban Glenview.

Attorney Raymond Niro told the Chicago Tribune that Billy Goat is suing in federal court, requesting a preliminary injunction to keep the Florida restaurant out of Sam's backyard.
