Although the pair split in 2014, Loeb is suing Vergara for the right to her frozen embryos in Louisiana, the only state that gives legal rights to frozen embryos. But Vergara has argued that the embryos were conceived in California and that neither she, Loeb or the embryos have any legal connection to the Bayou State.
In court documents obtained by TMZ, the judge ruled in Vergara's favor and said the actors' embryos are Californians.
According to the New York Post, when Vergara and Loeb were still together, they had her embryos cryogenically frozen through in vitro fertilization. The embryos are currently in California, but Loeb has been trying to get them shipped to Louisiana to hve them born.
Loeb has even named them "Emma" and "Isabella."
