Matthew Fox files counterclaim against bus driver

CLEVELAND, Nov. 8 (UPI) -- Television actor Matthew Fox has filed a counterclaim against the Cleveland charter bus driver who says he assaulted her while he was drunk, court papers show.

Heather Bormann has accused the former "Lost" and "Party of Five" star of striking her repeatedly when she told him hers was not a public bus and she could not take him to his hotel.

Bormann, a 29-year-old mother of three children, said Fox, 45, was drunk at the time and only stopped attacking her after she punched him in the mouth and three passengers came to her defense. An off-duty police officer working security for a nearby bar then arrested Fox.

Bormann filed her lawsuit against Fox shortly after the alleged incident.

The Cleveland Plain Dealer said Fox filed his counterclaim Nov. 3, requesting a jury trial.

Fox's attorney told the newspaper he could not comment on the counterclaim.
