Poison sued by former rockers

CHICAGO, Oct. 25 (UPI) -- The band Poison is being sued by two members of the now-defunct Chicago band Kid Rocker who allege Poison plagiarized some of their material.

The lawsuit, filed Wednesday in federal court by Billy McCarthy and James Stonich, alleges Poison used plagiarized material in "Talk Dirty to Me," "I Won't Forget You," "Fallen Angel" and "Ride the Wind."

Poison guitarist C.C. DeVille was allegedly lent master-recorded studio tapes after he auditioned for Kid Rocker in 1984, the lawsuit said. Kid Rocker, which had been signed to Atlantic Records and played in Los Angeles clubs in the 1980s, disbanded that year, The Hollywood Reporter said Wednesday.

The Illinois lawsuit alleges Kid Rocker songs "Hit and Run" and "Wham Bam Slammin' Romance" were later used by Poison in their own songs.
