John Malkovich wants more back from Madoff

NEW YORK, April 3 (UPI) -- Actor John Malkovich says he wants to recoup the millions he lost to admitted New York swindler Bernard Madoff.

Lawyers for Malkovich argued Friday in a New York court that the John Malkovich Pension Plan and Trust should be awarded $2.2 million, the assets the plan ostensibly held with Madoff before his Ponzi scheme unraveled, the New York Daily News reported. The trustee sorting out payments to Madoff investors found Malkovich was entitled to $670,000, the difference between what he invested and any payouts, an approach endorsed by the judge in the case.

"A customer generally expects to receive what he believes is in his account at the time the stockbroker ceases business," one of Malkovich's lawyers argued.

Madoff's multibillion-dollar fraud snared a number of celebrities, including Kevin Bacon and his wife, Kyra Sedgwick, and Elie Wiesel, the Holocaust survivor, author and Nobel Peace Prize winner.

The financial statements Madoff investors received were fictional. Madoff took in billions of dollars over 20 years, using the money to make payments to some investors and to pay for his own lifestyle.
