Lawyers Samantha Spector, representing Heard, and Laura Wasser, representing Depp, met in court Tuesday where Wasser stated to the judge that the Alice Through the Looking Glass star would not give his deposition until Amber does hers first according to E! News.
"This is really weighing heavily on my client," Wasser said of Depp.
The judge then ruled that the domestic violence hearing will take place on Aug. 17 as opposed to Aug. 15 and extended Heard's temporary restraining order, which was granted after she accused the actor of abuse, to the later date.
Neither Heard or Depp is allowed to present during each other's deposition.
Depp, 53, and Heard, 30, met while starring together in 2011's The Rum Diary and tied the knot in February of 2015. The actress filed for divorce in May citing "irreconcilable differences" just days after the death of Depp's mother.
