California Judge Ruth Kwan set a trial date of Nov. 17 for the lawsuit Kanye West and Kim Kardashian brought against the man they accuse of uploading to the Internet video footage of their engagement.

The power couple said YouTube founder Chad Hurley signed a one-page confidentiality agreement before their engagement event at San Francisco's AT&T Park, but he went ahead and posted video of the moment online anyway.

Hurley requested the suit be thrown out under California's anti-SLAPP statute, which is a lawsuit that's filed to intimidate and silence critics by overloading them with the cost of a legal defense.

Kwan denied Hurley's anti-SLAPP filing and set a trial date of Nov. 17, unless a settlement is reached before then.

The judge said Hurley could be liable for fraud, which means West and Kardashian could be due a big payday in punitive damages. We're talking millions.
