Capt. Monica McGrath of the Ventura County Sheriff's Department told the newspaper Avary's spouse, Gretchen, was thrown from the back seat of the car and taken to Ojai Valley Community Hospital with serious injuries.

Passenger Andreas Zedini died at Ventura County Medical Center after firefighters extricated him from the wreck, McGrath said.

TMZ.com said, Zedini, a friend of Avary's visiting from Italy, died of internal injuries, while Avary's wife was in stable condition as of Sunday night.

Avary was arrested on suspicion of felony driving under the influence and released after he posted $50,000 bail, McGrath told the Times.

"Roger wishes to publicly convey his heartfelt condolences to the family of the deceased. Words cannot express how sorry he is, and this tragic accident will always haunt him," said a statement released by Avary's representative to the newspaper.
