NEW YORK, Nov. 29 (UPI) -- Tracy Morgan took his second breath test in less than a year after New York police pulled him over in Manhattan.
Morgan registered .126 on the test Tuesday, close to the .13 he registered when he was stopped for speeding in Hollywood last December.
Manhattan prosecutors described him as "falling-down drunk," the New York Post reported.
Morgan rejected a plea deal offering a $1,000 fine and 5 days community service.
Charges from the December arrest may have influenced his decision to refuse the plea deal. TMZ.com says if he accepted the deal, Morgan would be guilty of violating probation on the prior DUI conviction.
He could face a year in prison on the latest charge. His court date is scheduled for Jan. 4.
