FORT MEYERS, Fla., Aug. 10 (UPI) -- A Florida judge says two members of the rock band Rush do not deserve damages for injuries their guitarist suffered in a Naples, Fla., brawl.
Geddy Lee and Neil Peart claimed they lost business after guitarist Alex Zivojinovich was injured in a 2003 melee at the Ritz-Carlton in Naples, The Naples (Fla.) News reported Thursday.
Zivojinovich, a Naples resident who goes by the stage name of Alex Lifeson, is seeking millions of dollars against deputies and the Ritz-Carlton, Naples, in a civil lawsuit filed in U.S. District Court in Fort Myers.
The judge agreed Zivojinovich has many legal arguments that can be made while dismissing his bandmates' claims, the newspaper said.
Zivojinovich said a deputy broke his nose as he charged up the stairs of the hotel to help his son, Justin, who was being zapped by a stun gun.
Deputies alleged Justin wouldn't comply with their orders to leave the hotel after getting onto a platform several times at the New Year's Eve bash and taking over the house band's microphone.
The father and son both settled criminal cases against them in plea deals.
Lawyers for both sides said they expect the federal trial to begin early next year.
