Suit against Stapp for sex video is tossed

MIAMI, April 20 (UPI) -- A Miami Circuit Court judge has tossed "Jane Doe's" suit seeking damages from rocker Scott Stapp over a sex tape she made with him in 1999.

The woman -- one of four taped having sex on a tour bus with the former Creed singer and Detroit's Kid Rock -- can re-file her suit within 20 days if she uses her real name, Miami-Dade Circuit Judge Gerald Hubbart ruled.

"There's no showing on why the claim should be allowed to proceed under a fictitious name," Hubbart wrote.

The woman was seeking unspecified damages from Stapp and Internet porn distributor World Wide Red Light District as well as an injunction preventing the sale of the video.

Her attorney told E! Entertainment her anonymous client has suffered emotional distress and was stigmatized by the video.

Kid Rock, who was not named in the Miami suit, recently settled his Detroit federal suit against World Wide Red Light District, which agreed to halt any marketing of the video.
