LOS ANGELES, Jan. 26 (UPI) -- The attorney for "Saturday Night Live" alumni Tracy Morgan is fighting the comedian's Hollywood drunken driving arrest, it was reported Thursday.
Morgan was pulled over Dec. 2 for speeding and subsequently charged with driving under the influence of alcohol. His attorney, Blair Berk, said in court Thursday her client was not breaking any laws when he was stopped by police, TMZ.com reported.
The attorney told the court she will prove her case when it comes to trial.
When asked if she would claim Morgan was a victim of racial profiling, the attorney replied: "I don't discuss pending court cases."
Berk is expected to ask that blood-alcohol test results thrown out during Morgan's hearing set for Feb. 23, TMZ.com said.
