Jury seated for Diaz photo trial

LOS ANGELES, July 13 (UPI) -- A jury has been seated for the Los Angeles of trial of a photographer who took topless pictures of actress Cameron Diaz before she was famous.

John Rutter is charged with attempted grand theft, forgery and perjury. He was originally accused of threatening to sell the photos if Diaz did not give him $3.3 million, but the blackmail charge was dropped, E! Online reported Wednesday.

The trial will focus on whether or not Diaz signed a release for the photos. Rutter claims she did, the actress claims her signature was forged. The photos are not expected to be displayed during the trial.

The six-man, six-woman jury was seated Tuesday and alternates were to be chosen Wednesday.

During Tuesday's proceedings, Superior Judge Michael E. Pastor told jurors Diaz would testify against Rutter.

Rutter pleaded innocent to the charges in 2003 and faces up to six years in prison if convicted on all counts.
