OTTAWA, Oct. 5 (UPI) -- People who are infected by the AIDS virus but have little risk of passing it to others do not have to disclose their HIV status, Canada's top court said Friday.
The ruling by the Supreme Court of Canada updated a 1998 decision that carriers of the HIV virus who do not inform their partners could be convicted of aggravated sexual assault, the Canadian Broadcasting Corp. reported.
The court vacated convictions in two cases in which the AIDS-infected people were on anti-retroviral drugs and using condoms.
The court found 9-0 that "realistic possibility of transmission of HIV is negated" by the combination of a condom and the drugs.
