Court weighs 2nd evaluation of Breivik

OSLO, Norway, Jan. 4 (UPI) -- Prosecution and defense lawyers said Wednesday they oppose a second psychiatric evaluation for admitted Norwegian mass murderer Anders Behring Breivik.

The second evaluation is being sought by attorneys for some of Breivik's 77 victims, The Local reported. An Oslo district court is expected to decide this month whether to order a new psychiatric evaluation.

The 32-year-old, right-wing extremist, who is to go to trial April 16, was found criminally insane when examined by experts following the horrific July 22 bomb and gunfire attacks.

In opposing a follow-up exam, defense attorney Vibeke Hein Baera said, "There is already a very detailed forensic medical evaluation of the accused."

Two prosecutors in the case agreed a new assessment was "not necessary," The Local said.

Two court-appointed psychiatrists concluded Breivik is a paranoid schizophrenic who could not be held criminally accountable for his actions.

The Local said under that diagnosis Breivik could be expected to be sentenced to psychiatric care in a closed ward rather than prison.

The finding outraged many in Norway who note he planned the attacks for years and carried them out methodically.

Breivik has confessed to the killings but says he isn't guilty of murder because he was waging war against multi-culturalism and the "Muslim invasion" of Europe, The Local said.
