Overall, the ICC Office of the Prosecutor has yet to make a formal decision on the Nigerian cases, but a report from the ICC Prosecutor on Preliminary Examination said the court will pursue its investigation.

On the Jos killings, the report said, "The ongoing examination of these events is determining whether some of these attacks were carried out in a coordinated and organized manner, although the available information is limited."

The report indicated a lack of evidence supporting the allegations of rape and sexual violence in Niger Delta, saying, "sufficient information, however, remains scarce and no precise numbers are available."
