
COLOMBO, Sri Lanka, May 4 (UPI) -- A Sri Lankan appeals court suspended the court martial of former Gen. Sarath Fonseka until it decides on his petition questioning the military trial.
Fonseka, who was arrested after President Mahinda Rajapaksa defeated him to win re-election in January, has claimed his arrest and detention under the military laws are unlawful, Lanka Newspapers reported.
The appeals court ordered the suspension of the military court's proceedings until it makes a determination on the application of Fonseka, who recently was elected to parliament while still in prison.
Colombo Page reported the suspension would remain in effect until May 21.
Fonseka faces charges of involvement in political activities while in active service, which he has denied.
Both the former general and Rajapaksa are regarded as heroes in Sri Lanka after the Sri Lankan military defeated the Tamil Tiger rebels a year ago, ending the 26-year rebellion for a separate homeland for the Tamil-speaking minority on the island nation. Since then Fonseka and Rajapaksa fell out and became political rivals in the elections.
Fonseka also faces military proceedings on charges stemming from military, which also he has denied.
