Louisiana judge rules state's gay marriage ban is unconstitutional

A district court judge in Louisiana rules that the state's ban on same-sex marriage is unconstitutional.

LAFAYETTE, La., Sept. 23 (UPI) -- A district court judge in Lafayette, La. ruled Monday that the state's ban on same-sex marriage is unconstitutional.

District Judge Edward Rubin ruling was in response to a lawsuit filed by a same-sex couple asking their California marriage be legally recognized in the state.

Although the ruling will not be public record until Tuesday morning, the state's Attorney General's Office said it has already filed an appeal.

The current ban on same-sex marriage in La. does not recognize marriages in other places where it is legal.

On Sept. 3 a U.S. District court judge ruled that La. has not violated the rights of six same-sex couples married elsewhere.

Joshua Guillory -- the couple's attorney -- said the ruling makes their marriage legal in Louisiana, affording them all rights that other marriages receive.
