In addition to the two counts of felony murder, he was indicted with malice murder, first-degree cruelty to children, second-degree cruelty to children, criminal attempt to commit a felony (sexual exploitation of a minor) and two counts of dissemination of harmful material to minors.
Prosecutors said Harris Internet searched how hot a car needed to be to kill a child before strapping his 22-month-old son in his car seat, stopping at a fast-food restaurant and working for eight hours. He didn't check the back sear of his car until midway through his drive home.
Cobb County Chief Magistrate Frank Cox said Harris would have had to notice since "the stench in the car was overwhelming."
The prosecution asserts Harris killed his son because he was an unfaithful husband who didn't want to be a father.
It was found that on the day of his son's death Harris texted six women who were not his spouse, some of them explicit, including a picture of his erect penis which he sent to an underage girl, reports CNN.
Leanna Harris, Justin's wife, insisted her husband was a good father and said he didn't intentionally kill their child.
"Ross is and was and will be, if we have more children, a wonderful father," Leanna said at the funeral in Tuscaloosa, Ala. "Ross is a wonderful daddy and leader for our household. Cooper meant the world to him."
