The prosecution filed a motion requesting Superior Court Judge Susan Garsh step aside, noting "antagonism and bias" against the prosecution in a previous case not related to the Hernandez case, the Hartford (Conn.) Courant reported Monday.
William McCauley, prosecutor of the Hernandez case, wrote in an affidavit supporting Garsh's removal she had engaged in biased conduct in the 2010 murder trial of George Duarte, who was found guilty in the shooting death of a teenager.
"The lead prosecutor and the trial judge currently assigned to this case have a well-known and publicly documented history of antagonism," McCauley wrote. "Her words, tone and behavior were unnecessary, discourteous and demeaning."
Hernandez, formerly of the NFL's New England Patriots, is charged with murder in the shooting death of Odin Lloyd. Lloyd had been dating Hernandez' sister.
