Renee Jo Lee filed a lawsuit last week in Hillsborough County against the Sunlake Pharmacy in Lutz, The Tampa (Fla.) Tribune reported Monday. Three pharmacists and two pharmacy technicians are named as defendants.
Lee had a miscarriage earlier this year after she took the pills, which her boyfriend at the time told her were antibiotics, the Tribune reported.
Lee's former boyfriend, John Andrew Welden, pleaded guilty to federal charges Sept. 9 under an agreement that could lead to a sentence of more than 13 years in prison. He admitted forging his doctor father's name to a prescription for Cytotec.
The lawsuit says a Sunlake employee -- whose name was not reported -- was aware Welden was using a forged prescription because the two discussed getting a prescription label for the bottle of Cytotec that would have Lee's name on it and a misleading description of the contents.
The lawsuit says the pharmacy was at fault because "a reasonably competent, concerned and safe pharmacist would have recognized the prescription ... was grossly in error" and would have consulted the doctor who had purportedly written it.
