Sgt. Thomas Winkis, 45, was also given a 30-day suspension and is expected to be fired at the end of that time, WCAU-TV reported.
David Farries, 55, died three days after the Sept. 14 crash. The impact threw him out of his van.
Winkis was also hospitalized.
The Farries family had been pushing for criminal charges. They also said they are angry because Winkis was given permission to surrender next week.
"If our dad was the one who killed a cop, he would have been in from day one," Tammie Farries told WCAU.
Winkis's ex-wife, Michelle, also a police officer, died Sept. 7 while she was at work, suffering a brain aneurysm. On Sept. 12, the Fraternal Order of Police held a fundraiser for the couple's children.
