ATLANTA, July 17 (UPI) -- Georgia has scheduled a new execution date this week for Warren Lee Hill, who was in prison for murder when he killed another inmate in 1990.
The state Department of Corrections set the execution for Friday at 7 p.m., The Atlanta Journal-Constitution reported Wednesday. He had been scheduled to die Monday.
Hill's lawyers say he is mentally disabled and thus not eligible for execution under a Supreme Court decision that bans the death penalty for those with IQ's under 70. His execution was delayed until after a hearing scheduled for Thursday on the drugs to be used.
The state turned to a pharmacy to compound a drug specifically for the execution because pharmaceutical companies have become unwilling to supply lethal injection drugs. Hill's lawyers say he has a right to know the name of the pharmacy.
Hill was sentenced to life for killing his 18-year-old girlfriend. In 1990, he fatally battered Joseph Handspike.
The current execution warrant expires at noon Saturday.
