Baby returned to Russian parents after dispute over medical treatment

SACRAMENTO, May 1 (UPI) -- A 5-month-old baby seized by U.S. authorities has been returned to his Russian parents after a California court dismissed child neglect charges against them.

Sammy Nikolayev was taken into protective custody after his parents got into a dispute with a doctor over the child's medical treatment, The Moscow Times reported Tuesday.

Police and child protective services charged the infant suffered from "severe neglect" when they took him April 24.

His parents had taken the child to Sutter Memorial Hospital for treatment of flu symptoms. Doctors there determined the boy needed immediate heart surgery. Seeking a second opinion, the parents took the baby from the hospital without being properly discharged.

After a five-hour hearing, a judge in Sacramento dismissed all charges against the parents.

However, the judge cautioned them to follow all medical advice in the future and not to take their son from a hospital without discharge papers.

The child is hospitalized for further treatment, but child protective officials said the parents would be allowed to be with him.
