Judge throws out three murder charges in Gosnell abortion trial

PHILADELPHIA, April 23 (UPI) -- Three of seven murder charges in the Philadelphia trial of Dr. Kermit Gosnell, charged with killing viable fetuses during abortions, were thrown out Tuesday.

Judge Jeffrey P. Minehart of Pennsylvania's Court of Common Pleas granted motions for acquittal of the charges of Gosnell, who operated a Philadelphia abortion clinic. Motions for acquittal in five counts of abuse of a corpse, and one of infanticide, were also granted, The New York Times reported Tuesday.

Prosecutors contend Gosnell killed living fetuses by plunging scissors into their necks, the newspaper said.

The judge gave no reason for his decisions in the trial, now in its fifth week
