Judge delays same-sex marriage decision

DETROIT, March 7 (UPI) -- A Michigan judge said Thursday he will await the U.S. Supreme Court's decision on same-sex marriage before he rules on the constitutionality of the state's ban.

"I think it's worth the wait," said U.S. District Judge Bernard Friedman in a hearing regarding a case brought by two women seeking joint custody of their three children. "I don't know what the Supreme Court is going to do."

The decision disappointed proponents of same-sex marriage who hoped Friedman would strike down the ban Michigan voters approved in 2004, the Detroit Free Press reported Thursday.

The case was brought by April DeBoer and Jayne Rowse of Hazel Park, Mich., seeking joint custody of DeBoer's adopted daughter and Rowse's two adopted sons. Michigan law prohibits joint custody by unmarried couples, The Detroit News said.
