CHARLOTTE, N.C., Jan. 23 (UPI) -- A retired teacher has been charged with indecent liberties with a student at a Charlotte, N.C., elementary school 30 years ago.

Monte Sue Diebolt's attorney said Tuesday she will enter a not guilty plea to the charge, The Charlotte Observer reported. Diebolt, now 73 and living in Statesboro, Ga., is free on bail after surrendering to authorities in Charlotte.

Melissa Owen represents the alleged victim, a 41-year-old man who said he was in Diebolt's sixth-grade class when she made him touch her "inappropriately and against his will." Owen said her client told her Diebolt gave him notes and candy and then left a note in his textbook asking him to stay behind after class.

"My client decided that this was a wrong that he needed to right," Owen said.

Diebolt apologized to the man, Owen said. She did not know he reported her to police last February and investigators were listening to the conversation.
