BOSTON, Jan. 15 (UPI) -- Boston lawyers for suspected mobster James "Whitey" Bulger said a jury -- not a judge -- should determine if there is enough evidence he was granted immunity.
Lawyers J.W. Carney Jr. and Henry B. Brennan filed a memorandum in U.S. District Court Monday saying it is not up to the judge to determine if Bulger's claims of immunity are valid prior to his June trial, the Boston Globe reported Tuesday.
"The Department of Justice's grant of immunity to James Bulger does not raise the type of constitutional issue that allows intervention by the judiciary," the document read.
Federal prosecutors said it is "frivolous and absurd" that Bulger has said he was granted immunity so that he would not be prosecuted for any of his crimes including 19 alleged murders in the 1970s and 1980s in exchange for acting as an FBI informant.
