Ill. attorney general seeks gun ban review

CHICAGO, Jan. 8 (UPI) -- The Illinois attorney general has filed a petition to have a judicial ruling striking down a ban on concealed handguns reviewed.

Lisa Madigan's petition asks the full U.S. Court of Appeals for the Seventh Circuit to review the December appeals panel ruling that the state's longtime ban on carrying concealed weapons in public violates the Second Amendment, the Chicago Tribune said Tuesday.

If the court accepts the petition the case will be re-heard by all 10 appellate judges; if the petition is rejected the attorney general could ask the U.S. Supreme Court for review.

"In ruling that Illinois must allow individuals to carry ready-to-use firearms in public, the Seventh Circuit Court's decision goes beyond what the U.S. Supreme Court has held," Madigan said in a statement issued Tuesday.

The appeals court ruling pertains to a landmark decision of the U.S. Supreme Court in 2010, McDonald vs. Chicago, in which it was determined the Second Amendment's right to "keep and bear arms" is protected, and applies to state law.
