Penn State perjury trial to proceed

STATE COLLEGE, Pa., Sept. 26 (UPI) -- The perjury case against two former Penn State University administrators in the Jerry Sandusky child-rape case will go forward, a judge said Wednesday.

Judge Todd Hoover denied motions by attorneys for former Athletic Director Tim Curley and former Senior Vice President Gary Schultz to drop the perjury charges against them, for allegedly lying to a jury about their knowledge of Sandusky's serial sexual abuse of young boys, StateCollege.com reported.

Hoover upheld the felony perjury charge but did not rule on the summary charge of failure to report faced by both Curley and Schultz, court documents indicate.

The failure to report charge, which Hoover is expected to address in a separate ruling, relates to a 2001 incident that has passed the statute of limitations. In that incident, graduate student Mike McQueary told head Coach Joe Paterno he saw Sandusky sodomizing a boy in the Lasch Football Building locker room shower.

Paterno reported the incident to Curley and Shultz, who allegedly failed to report the crime to authorities.

Sandusky, 68, was convicted June 22 on 45 counts of sexually abusing 10 boys and is scheduled to be sentenced Oct. 9.

The perjury trial for Curley and Schultz is scheduled to begin Jan. 7.

Paterno died Jan. 22 at age 85.
