Mom beaten by 11-year-old dies

ELK GROVE, Calif., Sept. 19 (UPI) -- Police in California said they won't file additional charges against an 11-year-old boy accused of beating his severely disabled mother who later died.

Police Chief Chris Trim of Elk Grove, Calif. told KOVR-TV, Sacramento, that 51-year-old Tracey Gipaya lived alone with her son who ended up as her unofficial caregiver.

"I cannot recall a case in which a kid has been taken into custody on charges of abusing a parent who has fiduciary responsibility for the child," Trim said. "Typically the situation is reversed."

Trim said the boy was arrested on charges of assault with a deadly weapon and elder abuse after his mother was beaten so badly she had to be hospitalized and later died.

Investigators said her death was a result of a pre-existing condition and they do not anticipate filing new charges against the boy.

A juvenile court judge awarded temporary custody of the child to his father.
