FLAT ROCK, Mich., July 30 (UPI) -- A judge told two Flat Rock, Mich., men Monday they will have to wait a month to hear if they will receive a bond as they await retrial.
The judge said the bond hearing for Raymond and Thomas Highers, both 46, will be delayed until Aug. 13 because various documents from the Michigan Department of Corrections had yet to arrive, The Detroit News reported.
The Highers brothers were convicted in 1988 of killing 65-year-old marijuana dealer Robert Kerry. They earned a retrial Thursday as a result of new evidence stemming from a Facebook chat with a witness to the crime indicating the killers were black. The Highers are white.
The Highers brothers are seeking release from prison because the judge threw out their convictions.
"It's just frustrating," the Highers' younger brother, Scott, said. "It's been 25 years. The judge made the decision Thursday to throw out the conviction. It's ridiculous. Frustration can't even explain how I feel. He made the decision. What's the problem?"
