Loughner requests psych notes withheld

PHOENIX, Feb. 15 (UPI) -- The lawyer for the man accused of shooting Gabrielle Giffords and 18 others in Arizona has asked that his psychologist's notes be withheld from prosecutors.

Attorney Judy Clark requested the judge not allow prosecutors to see notes on Jared Lee Loughner's sessions with a prison psychologist because "they contain potentially incriminating statements allegedly made by Mr. Loughner in response to Dr. [Christina] Pietz's questioning," The Arizona Republic, Phoenix, reported Tuesday.

Pietz included 62 pages of notes from meetings with Loughner between October 2011 and February 2012 alongside a report she submitted on Loughner's competency earlier this month. Clark said the statements Loughner made to Pietz were under duress because he was ordered into treatment.

Loughner, 23, is accused of a mass shooting Jan. 8, 2011, outside a Tucson grocery store where U.S. Rep. Giffords was holding a community event. Six people were killed and 13 others, including Giffords, were wounded.
