Tainted melon in wrongful death suit

KANSAS CITY, Mo., Jan. 4 (UPI) -- The son of a 92-year-old Kansas City man, in a wrongful death lawsuit, alleges tainted cantaloupe caused his father's death, attorneys said.

Attorneys for Paul A. Schwarz, the father, filed an amended lawsuit against Colorado grower Jensen Farms and distributor Frontera Produce, claiming the cantaloupe was the cause of the man's death, The Kansas City Star reported Tuesday.

The lawsuit was filed on behalf of Schwarz's son, Paul F. Schwarz of Independence, Mo.

Federal health officials last fall linked cantaloupe from Jensen Farms to 146 cases of listeriosis, a bacterial infection, and 30 deaths and one miscarriage were reported. The tally was finalized before Schwarz's death, the Star said.

Schwarz, who died Dec. 18, developed listeriosis in September after eating cantaloupe traced to Jensen Farms and was hospitalized for five weeks. He was in a nursing home when his lawsuit was filed in October.
