SACRAMENTO, Dec. 20 (UPI) -- The California Supreme Court has upheld the guilty verdict of a death row inmate convicted of the 1997 murder of her four sons.
Monday's unanimous ruling means Susan Dianne Eubanks, currently imprisoned at the Central California Women's Facility in Chowchilla, will remain on death row for the Oct. 26, 1997, shooting deaths of sons Brandon Armstrong, 14; Austin Eubanks, 7; Brigham Eubanks, 6; and Matthew Eubanks, 4, at her San Marcos, Calif., home, The San Diego Union-Tribune reported.
Susan Eubanks had been convicted in 1999 by a Superior Court jury of four counts of first-degree murder with a recommendation of the death penalty. The trial featured testimony that Eubanks, while engaged in divorce proceedings from her husband, shot her sons following an argument with her live-in boyfriend.
Eubanks had raised many issues in the unsuccessful automatic appeal, including an allegedly improper search of her San Marcos home, the screening of prospective jurors, and testimony from an expert witness for the prosecution, the newspaper reported.
