LOUISVILLE, Ky., Oct. 17 (UPI) -- A Jefferson County circuit judge Monday set a March 5 trial date for a man charged with shooting a 12-year-old boy in Louisville, Ky.
Assistant Commonwealth's Attorney Leland Hulbert said the prosecution and defense attempted to reach a plea deal in the case but "couldn't agree," The (Louisville) Courier-Journal reported.
Michael Bishop, 57, is charged with assault, wanton endangerment and tampering with physical evidence in the June 13 incident in which police say Bishop shot Jacob Eberle, 12.
Eberle and several other children were apparently playing a game in which they ran up to people's homes, rang doorbells or knocked and then ran away.
Bishop told police he was "scared and confused" as he grabbed a shotgun after hearing a noise outside his home. He said he hoped only to scare away what he thought was a burglar.
Bishop, who is out on bail, pleaded not guilty to the charges, for which he could get a maximum of 30 years in prison if convicted.
