After police secured the area, a police diver retrieved the unloaded assault weapon and 40 bullets of various calibers, San Diego police Detective Gary Hassen said.

Hassen said it did not appear the MAC-10, which is illegal to own in California without proper permitting, had been in the water long.

The gun was impounded and its serial number was being check to locate the owner.
