Trump suit against Fla. airport dismissed

WEST PALM BEACH, Fla., Dec. 1 (UPI) -- A Florida judge has rebuffed Donald Trump's attempt to shoo airplane flights away from his Palm Beach club.

Circuit Court Judge Joseph Marx dismissed Trump's lawsuit claiming that noisy flights from the county airport were harming Mar-a-Lago's property values and his ability to use the historic property, the South Florida Sun-Sentinel reported.

The tycoon's suit aimed to ban flights over Mar-a-Lago, stop a proposed airport expansion and accused airport director Bruce Pelly of "intentional battery" for refusing to shift flight paths or make other changes to mitigate the disruptions.

Marx did leave Trump the option to file an amended lawsuit within 20 days.

Attorney James Beasley said his client will re-file and keep pushing for changes at the airport, which is 2.5 miles from the club.

"The current way that the county has flights out of the airport is creating a nuisance," he said. "If you were ever at Mar-a-Lago when an airplane is going over, you can't talk."

The judge agreed with the county's position that the Federal Aviation Administration controls flight paths.

Trump's suit already has cost Palm Beach County some $50,000 for outside attorneys. If the case continues, it could incur $500,000 more.
