
CHICAGO, July 28 (UPI) -- An inmate who allegedly received pot-filled pens from a Cook County sheriff's deputy faces a felony charge but the deputy may go free, Chicago prosecutors say.
Brian Gollsby, 28, allegedly had the pens filled with marijuana hand-delivered to him earlier this month while he was in a lockup area at the Cook County Criminal Courts building, the Chicago Tribune reported Wednesday.
But prosecutors have decided not to charge the 40-year-old deputy who gave him the pot pens because sheriff's investigators did not follow specific instructions designed to ensure the deputy knew she was delivering drugs.
One source familiar with the incident said sheriff's undercover investigators had been instructed to leave the marijuana exposed so the deputy couldn't claim ignorance.
A spokesman for the Cook County State's Attorney said as a result, there wasn't sufficient evidence to charge the deputy who was arrested after the incident. The newspaper said it wouldn't identify the deputy because she was not charged.
The inmate has been charged with felony contraband.
