ST. PETERSBURG, Fla., April 28 (UPI) -- A Florida man with leukemia will appeal a ruling his brother can't be forced to donate bone marrow or return the money he was paid for it, his lawyer says.
David Dreier told a Hillsborough circuit judge he gave his brother Michael $37,500 so Michael would donate his bone marrow for a transplant, the St. Petersburg (Fla.) Times reports.
Dreier, 48, says his brother reneged on the agreement and has also refused to return the money.
Michael Dreier, 51, testified the money was a loan and he is unable to donate marrow for medical reasons.
Because it is illegal to buy or sell marrow, Judge Robert Foster ruled in Michael Dreier's favor Monday in a suit filed last September.
Randall O. Reder, David Dreier's attorney, said they plan to appeal Foster's decision.
"He won on a technicality," David Dreier said.
