Ohio mother cleared in daughter's death

COLUMBUS, Ohio, Jan. 20 (UPI) -- An Ohio jury has decided a woman who fatally shot her 27-year-old daughter during a dispute at their Columbus home isn't guilty of murder.

The Columbus Dispatch reported a Franklin County Common Pleas jury found Cindy Crump, 48, innocent on murder charges Tuesday in the Jan. 3, 2009, death of her daughter, Kiana Davis.

Crump's attorney, J. Tullis Rogers, argued during her trial that Crump did not want to shoot her daughter after they got into a physical confrontation over unwashed dishes.

"She went and got the gun to stop all this nonsense that was going on," Rogers argued. "To convict her of murder, you'd have to believe she was lying to you and intended to kill her daughter."

Crump's testimony during her trial supported the defense stance that the gun accidentally discharged.

"I love my child," Crump testified. "I would never kill my child. I was surprised the gun went off."

The Dispatch said Assistant County Prosecutor Mark Wodarcyk contended the defendant owned the gun for 26 years and knew how it worked.
