
LAS VEGAS, Dec. 14 (UPI) -- Attorneys for a Las Vegas casino said a lawsuit against the site for allegedly putting employees at risk due to second-hand smoke is politically motivated.
Attorneys with the law firm Brownstein Hyatt Farber Schreck LLP are seeking a dismissal of the lawsuit against Wynn Las Vegas, alleging their client follows regulations outlined under the Nevada Clean Indoor Air Act, the Las Vegas Sun reported Sunday.
The casino's attorneys also allege the federal lawsuit, filed by Transport Workers Union officer Kanie Kastroll, is part of a "political agenda" involving the casino's dealers.
"The real basis for this action appears by all measures to be the pursuit of a political agenda," the casino's attorneys argued in court papers filed Friday.
Kastroll, who is also a casino dealer, alleges in his Oct. 20 suit that exposure to second-hand smoke in the casino is causing various medical problems ranging from eye irritation and sore throat to asthma and the ingestion of cancer-causing chemicals.
The Sun said the Transport Workers Union Gaming Division has distanced itself from Kastroll's lawsuit, which is seeking unspecified costs and fees in addition to an order for the casino to take steps to better protect its employees from second-hand smoke.
