Canada's high court to rule on Gitmo man

OTTAWA, Sept. 4 (UPI) -- The Canadian government's refusal to seek repatriation of a man held by the U.S. military in Cuba will be taken up by the Canadian Supreme Court, officials say.

The court in Ottawa announced Friday it will expedite the Ottawa government's request appealing federal court orders to bring 22-year-old Omar Khadr back from the Guantanamo Bay prison where he's been held since his arrest in Afghanistan when he was 15.

Khadr is a Toronto native charged with throwing a grenade that killed a U.S. army medic in July 2002, the Canwest News Service reported.

Prime Minister Stephen Harper's Conservative government has repeatedly resisted calls for Khadr's repatriation, saying he must face U.S. justice for the serious charges against him, the Globe and Mail reported.

Khadr is the only Western prisoner still at the detention facility.

The high court said it would hear the case Nov. 13.
