
SAN FRANCISCO, June 30 (UPI) -- A judge in San Francisco said there is enough evidence to hold a 22-year-old immigrant from El Salvador on charges of killing a man and two of his sons.
Superior Court Judge Teri Jackson ordered Edwin Ramos held for trial Monday after a 10-day preliminary hearing, the San Francisco Chronicle reported. Jackson read off charges that included murder with special circumstances, multiple victims and an alleged gang crime.
Tony Bologna, 48, and his sons, Matthew, 16, and Michael, 20, were in a car near their home in San Francisco when they were shot on June 22, 2008. Prosecutors say the shooters were members of MS-13 who mistook one of the sons for a member of a rival gang.
A surviving son identified Ramos as the shooter during the hearing. But Ramos's lawyer, Marla Zamora, said his client drove the car the shooters used but did not kill anyone.
"Either (police) didn't want to get the real shooter or they felt a bird in the hand was worth two in the bush," she said.
District Attorney Kamala Harris is an opponent of the death penalty, so the finding of special circumstances does not mean Ramos will face execution if convicted.
