AUSTIN, Texas, June 21 (UPI) -- A Texas judge says he did not make good on a threat to jail a woman for violating his order not to have more children because she "seemed to be doing well."
District Judge Charlie Baird told Sunday's Austin American-Statesman he did not jail Felicia Salazar during an appearance by her in his courtroom last week even though she had a 2-month-old baby in tow -- 10 months after he controversially barred her from having more children as a condition of her probation.
Salazar reportedly told Baird she was pregnant when she was given the probation on charges of injury to a child by omission. Salazar had admitted failing to provide protection and medical care to her then-19-month-old child in 2007, the newspaper said.
The demand that she have no more children while on probation prompted national legal experts to question whether the condition was constitutional or enforceable, but Baird said he declined to jail Salazar last week.
"She's remarried," Baird said. "She seemed to be doing well."
