Disappointed moms sue maker of gender test

NEW YORK, June 16 (UPI) -- Six New York women have sued the maker of a "99.9 percent accurate" test for the gender of a fetus, saying that it fails to live up to its claim.

The plaintiffs say they used the Baby Gender Mentor test early in pregnancy, learning later through a sonogram its results were wrong, the New York Post reported. Accu-Gen Biolab, which produces the Baby Mentor Monitor retailing for $275, advertised it as giving accurate results as early as 5 weeks into a pregnancy.

Barry Gainey, representing the six women in the lawsuit filed in Manhattan Supreme Court, told the Post company officials have acknowledged in a federal lawsuit that 10 to 20 percent of those who bought the test sought refunds because the results were wrong.

One woman said the test contributed to the breakup of her marriage. She said she used the test in her second pregnancy, when she and her husband were hoping for a son after having a daughter, and then gave him the news when the test predicted a boy. Weeks later, she learned from a sonogram she was carrying a girl.
