
SAN DIEGO, June 1 (UPI) -- The U.S. Marines Corps says it will continue the prosecution of a San Diego private who was allowed to enlist despite his admission that he is autistic.
Pvt. Joshua Fry, 21, faces charges of child pornography and being absent without leave. He is being treated with medication while awaiting a possible court-martial.
The San Diego Union-Tribune said Monday the corps recently rejected an argument by Fry's civilian attorney that the military didn't have jurisdiction in the case because Fry's enlistment shouldn't be considered legal.
The newspaper said Fry was diagnosed with autism when he was 8. Court documents show Fry told doctors and his commanders about his condition during boot camp this year.
Orange County attorney Mike Studenka said in a 35-page legal brief that Fry was under a court order prohibiting him from signing contracts and that the recruiter who signed him up for military service did so to meet his enlistment quota.
