Victim in negligent homicide not dead

LAYTON, Utah, Feb. 19 (UPI) -- An official in Davis County, Utah, says a negligent homicide case filed in a motorcycle accident is missing a body.

Deputy Davis County Attorney Steve Major said Wednesday he incorrectly assumed Bryant Mavretic, the passenger in a serious Aug. 1 motorcycle crash, had died and the vehicle's operator, Jordan J. Creswell, should face criminal charges, The Salt Lake Tribune reported.

Major said his incorrect assessment of the case appeared to have been caused by a Utah Highway Patrol report regarding the accident.

"My recollection is (UHP) brought it over and said, 'We needed to staff this for negligent homicide,'" the Davis County official said of the 2008 case.

UHP Trooper Cameron Roden told the Tribune that Mavretic's injuries had been considered life-threatening following the accident, which allegedly occurred after Creswell's speeding motorcycle struck a car.

Major said despite the negligent homicide charge snafu, the reckless driving and unlawful alcohol possession charges against Creswell will likely not be dropped.
