INDIANAPOLIS, Dec. 14 (UPI) -- Indiana Attorney General Steve Carter plans to announce legal action against a Texas company that reportedly violated a state law restricting marketing by fax.
A lawsuit against Envarion Corp. will seek damages for sending so-called junk faxes, the Indianapolis Star reported Sunday.
"We're alleging they had the largest number of violations in the law's history," said Carter spokeswoman Emily Potter.
The Indiana Telephone Consumer Protection Act of 2006 says fax machines cannot be used to send unsolicited advertisements to other fax machines in the state.
Charities, advocacy groups and organizations with which a fax machine's owner has a business relationship are exempted from the law, which went into effect Jan. 1, 2007.
The law provides for penalties of $500 or more for each violation.
